Abstract
This article proposes a model for the development of land management and land use plans under native title. The mediation processes established under the Native Title Act 1993, often involve indigenous claimants preparing a plan which sets out their aspirations, caters for the interests and rights of other parties with pre-existing interests and provides for management of the land and resources in the area under claim. With reference to the new planning context created by common law and statutory recognition of native title, the article suggests that planning processes initiated by native title claims need to emphasise indigenous participation and control, while seeking innovative land management regimes which cater for the co-existence of different interests. The proposed three part model emphasises indigenous participation, mutual learning and negotiation.
