Abstract

This article revisits the area of establishing fiduciary obligations between parties to unincorporated joint ventures and emphasises the importance to the courts of the contractual context of the joint undertaking. This was again evident in a recent New South Wales decision, Farah Constructions Pty Ltd v Say-Dee Pty Ltd.
