Abstract

In 2020, Australia looked to be a strong contender for the right to repair policy reforms being sought by the international right to repair movement, with the release of a nation-wide inquiry into the barriers experienced by Australians who wanted to repair their own devices, equipment, and machines that they own. The Australian Productivity Commission's Right to Repair Inquiry concluded in 2021 after its 12-month public inquiry into what an Australian Right to Repair would look like , with a number of key recommendations that would enhance consumer rights to repair: including ways to promote competition, enable access to repair supplies and and address the significant waste issues created through the inability to repair. An examination of the right to repair movement in Australia is conducted through a series of Australian industry-specific case studies: the automotive aftermarket; the agricultural machinery aftermarket; and the consumer electronics and appliances industry. While many of the proposed reforms, such as copyright, consumer and competition law reforms, have yet to be implemented, the attention that the right to repair has gained through this Inquiry in Australia has highlighted the need for urgent multi-faceted policy and regulatory interventions that will move the broader notion of a Right to Repair from a social movement to a legal right in Australia.
