Abstract
The patentability of human stem cells has been the subject of fierce debate in recent years. This paper analyses the very important issue and frames the debate regarding whether human stem cell-related inventions should be patentable. The paper also considers some of the key judicial decisions related to patenting human stem cells and discusses recent developments in the patentability of stem cells by comparing legal issues in Australia, the United States and Canada.
